What is Aid and Attendance?

The VA Aid and Attendance benefit is a pension for qualifying veterans or their surviving spouses. This benefit is specifically designed for individuals who need assistance with essential daily activities, such as bathing, dressing, eating, or managing their medications. The Aid and Attendance benefit can make a significant difference in the quality of life for veterans, allowing them to afford in-home care, assisted living, or nursing home expenses.

We work closely with you to:

Assess your eligibility

Gather Essential Documentation

The VA requires detailed documentation, including proof of wartime service, medical evidence, and financial statements. Our team assists you in gathering and preparing all necessary paperwork to avoid delays or denials.

Submit a complete application

We know how important it is to get it right the first time. Our attorneys help you complete and submit your application, minimizing the risk of mistakes that could slow down the approval process.

Appeal Denied Claims

If your claim is denied, don’t give up. Our legal team will review your case and assist with the appeals process to ensure you have the best possible chance of receiving the benefits you’re entitled to.

are you eligible for VA aid and attendance benefits?

Disabled Wartime Veterans Over Age 65

Eligibility for Aid and Attendance is based on several criteria. First, the veteran must have served at least 90 days of active duty, with at least one day during a recognized wartime period. The veteran’s discharge must be anything other than dishonorable.

In addition to service requirements, the applicant must be at least 65 years old or have a permanent disability that requires assistance with daily living.

Disabilities that may qualify for Aid and Attendance include:

Surviving spouses of veterans can also qualify for these benefits, provided they meet the same eligibility criteria.

How is wartime service defined?

Active Duty, But No Combat Zone Service Required

For veterans to qualify for Aid and Attendance benefits, they must have served during one of the VA’s designated wartime periods.

These periods include:

World War II

December 7, 1941, to December 31, 1946

Korean War

June 27, 1950, to January 31, 1955

Vietnam War

November 1, 1955, to August 4, 1964 (only if serving IN Vietnam during this time)

August 5, 1964, to May 7, 1975

Persian Gulf War

August 2, 1990, through a date to be determined by future presidential proclamation

The veteran does not need to have served in a combat zone but must have been on active duty during one of these periods to qualify.

What can aid and attendance cover?

Daily Care Needs

Aid and Attendance benefits are designed to help veterans cover the costs associated with their daily care needs.

This can include:

In-Home Care

Many veterans prefer to receive care in the comfort of their own homes. Aid and Attendance can help cover the cost of a caregiver who assists with daily tasks, allowing veterans to maintain their independence.

Assisted Living Facilities

For veterans who need a more structured care environment but do not require a nursing home, Aid and Attendance benefits can help cover the cost of an assisted living facility.

Nursing Home Care

Veterans who need 24-hour care in a nursing home due to severe medical conditions can also use Aid and Attendance benefits to cover these expenses.

At Ethos Law, we help veterans and their families understand how these benefits can be used. We work with you to ensure that you receive the full amount that you are entitled to.
